Nurses and midwives at Mount Gambier Hospital were shocked to receive advice from their employer that they will not receive payment for public holidays they are not required to work unless they have worked more than 40% (or 50% for perioperative staff) of the days of the week on which the public holiday falls.
The ANMF (SA Branch) understands a
Country Health SA – People and Culture Directorate instruction has informed this policy.
However, there is no provision in the Nurses (South Australia Public Sector) Award 2002 nor in the Nursing/Midwifery (South Australian Public Sector) Enterprise Agreement 2016 that states 5 or 7 day week workers (whether part-time or full-time) must have worked any fixed proportion of their rostered shifts on a certain day to receive payment of a public holiday not worked. As such, we are following up this policy with Country Health SA (CHSA) and will keep members updated on any progress.
The
ANMF (SA Branch) wrote to Regional Director of Nursing and Midwifery for the South East Paul Bullen seeking confirmation the health service will comply with the provisions of the award and agreement immediately and has received this
response from CHSA .
