Employment Tribunal Orders Discriminatory Letter To Be Rescinded

11 April 2019

An ANMF (SA Branch) win at the SA Employment Tribunal (SAET) today has brought relief to staff at Northern Adelaide Local Health Network (NALHN) who were on the receiving end of a letter that constituted a clear breach of the Equal Opportunity Act.

You may recall earlier this month we reported that NALHN had issued a letter (excerpt below) to a targeted group of staff about their taking of sick leave.

NALHN had declined multiple requests by the ANMF (SA Branch) to rescind the letter, so we were left with little choice but to take it to the SAET.

As a result of the conference in SAET,
NALHN has agreed to write to affected employees to rescind the letters and to set out a new approach that will be undertaken in order to resolve any existing concerns with the individual. Relevant staff will receive this letter shortly.

The new letter may require individuals to meet with NALHN to discuss their specific circumstances but will have the option of ANMF (SA Branch) representation during that process.

If you require individual representation, please contact our Duty Officer on 8334 1900.
